{"id":1907,"date":"2015-12-03T16:18:59","date_gmt":"2015-12-03T15:18:59","guid":{"rendered":"http:\/\/www.tuppenceworth.ie\/blog\/?p=1907"},"modified":"2015-12-03T16:23:39","modified_gmt":"2015-12-03T15:23:39","slug":"department-of-education-abandons-threat-to-defund-for-this-year","status":"publish","type":"post","link":"https:\/\/www.tuppenceworth.ie\/blog\/2015\/12\/03\/department-of-education-abandons-threat-to-defund-for-this-year\/","title":{"rendered":"Department of Education abandons threat to defund Junior Infants&#8217; schooling for &#8220;this year&#8221;"},"content":{"rendered":"<p>I made <a href=\"https:\/\/www.tuppenceworth.ie\/blog\/2015\/11\/13\/complaint-regarding-the-legality-of-the-current-primary-online-database-scheme-as-it-applies-to-junior-infants\/\">a complaint regarding the treatment of Junior Infants <\/a>data by the Department of Education in their latest effort to make their Primary Online Database legal.<\/p>\n<p>I received no substantial response, and so I forwarded the complaint to the Data Protection Commissioner.<\/p>\n<p>After that, I received the reply below. It is worth noting that this is the first public acknowledgement that the threat to defund 5 year olds&#8217; education has been postponed, for &#8220;this year&#8221;.<\/p>\n<p>***<\/p>\n<blockquote><p>Dear Mr McGarr,<\/p>\n<p>In relation to the points raised in your communication.<\/p>\n<p>1. Enclosed please find copy email sent to all schools on the 25th of August confirming that for this year there is no question of withholding funds.<\/p>\n<p>2. In our view the Judgment of the Court of Justice of the European Union in the Smaranda Bara case does not apply to the present facts.<\/p>\n<p>3. We  note the reference to the explanatory note in S.I. 317\/2015 which does not form part of the Statutory Instrument.
