The explanation speaks for itself. But here are some questions for my clever readers. If the camera is showing a blank screen when it is moving over the private property, can I get any CCTV camera pointed at my private property similarly adjusted?<\/p>\n<blockquote><p>I received a complaint concerning one of the CCTV cameras on the Luas line which the<br \/>\ncomplainant stated completely overlooked his back garden, giving rise to the feeling that<br \/>\nthe family were under constant surveillance and were unable to enjoy their private<br \/>\nproperty because of the presence of the camera. <\/p>\n<p>Connex, the Luas operators, acknowledged that the<br \/>\ncamera could indeed monitor parts of the<br \/>\ncomplainant\u2019s back garden. My Office indicated that<br \/>\nthe rules of data protection require that personal<br \/>\ndata recorded must be relevant and not excessive for<br \/>\nthe purposes for which it is obtained. In relation to<br \/>\nCCTV cameras, this means that the camera must be<br \/>\npositioned so that it cannot capture non-relevant<br \/>\nimages in its vicinity. <\/p>\n<p>Connex informed this Office that their policy in<br \/>\nrelation to CCTV was that cameras are to be used to<br \/>\nmonitor public areas and should not be used to<br \/>\nmonitor private areas. They agreed that the camera<br \/>\nin question could monitor sections of the<br \/>\ncomplainant\u2019s back garden. The Commissioner<br \/>\ntherefore directed that Connex immediately take the<br \/>\nnecessary steps to rectify the matter so that the<br \/>\ncamera\u2019s range makes it impossible to enable<br \/>\nmonitoring &#8211; albeit inadvertent &#8211; of the<br \/>\ncomplainant\u2019s private property. <\/p>\n<p>Connex then modified the system so that the<br \/>\ncamera \/monitor was now showing a black screen<br \/>\nwhen moving over the private property in its range.<br \/>\nThey also said that these settings cannot be changed<br \/>\nby the personnel who are using the cameras and<br \/>\nmonitors in the Central Control Room of Connex.<\/p>\n<p>I was satisfied that this solution resolved the issue<br \/>\nand that Connex were now aware of and fulfilling<br \/>\ntheir obligations and responsibilities under the Data<br \/>\nProtection Acts. <\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"Another case study.
